These terms apply when you use gametoughgear.com, operated by GAME TOUGH™ (“we,” “us”). By using the site or placing an order, you agree to them. If you don’t agree, please don’t use the site. If you are under 18, a parent or guardian should review these terms and make purchases for you.

Placing an order is an offer to buy. An order is confirmed only after payment succeeds and you receive our confirmation. We may decline or cancel an order — for example, if an item is unavailable, a price was shown in error, or we suspect fraud — and if we do, we will refund any amount charged for that order.

Product photos and color previews are shown as accurately as we can, but colors on your screen may differ slightly from the finished item.

Prices are in U.S. dollars and are shown at checkout, along with any shipping, tax and discounts. Our checkout calculates the final total; that total is what you pay. Payments are processed securely by Stripe — we never see or store your full card number. Discounts follow the rules shown on the site, and unless the site says otherwise, only one discount applies per order.

Shipping options, costs and delivery areas are shown on the site and at checkout. For questions about shipping, returns, exchanges, damaged items, or an order, contact contact@gametough.com. We will explain the options available for your order consistent with applicable law.

MVP Rewards is free to join. Benefits, offers and rules are described on the site and may change or end at any time. Rewards have no cash value and can’t be transferred or sold. Text messages are sent only if you opt in; see our Privacy Policy for details, including how to reply STOP to opt out.

The Combine is a skill game you pay to enter. Your entry includes the number of official attempts shown at purchase. Official scores are checked by our servers; we may void scores that appear to come from cheating, bugs or tampering. Offline or practice play is for practice only and does not count toward rankings or discounts.

Some scores can earn a merchandise discount code, as shown on the site. Discounts are not guaranteed, have no cash value, are not exchangeable for money and apply only to eligible merchandise. There are no cash prizes or guaranteed winnings. The entry fee pays for game access and is not a wager.

Please don’t misuse the site. That includes: breaking the law, trying to hack, overload or reverse-engineer the site or the game, manipulating scores, using bots or automated tools, submitting false information, or interfering with other people’s use of the site. We may block access or cancel entries for misuse.

GAME TOUGH™, our logos, designs, artwork, game and site content belong to us or our licensors and are protected by law. You may not copy, sell, reproduce or use them without our written permission. If you submit artwork for a team order, you confirm you have the right to use it.

We use outside services to run the site, such as payment processing, hosting, shipping, text message delivery and visitor statistics. Their own terms and privacy policies apply to their services, and we are not responsible for them. Links to other websites are provided for convenience only.

To the extent allowed by applicable law, the site and the Combine game are provided “as is” and “as available.” We don’t promise the site will always be available, error-free or secure. The Combine is entertainment, not athletic training or evaluation.

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential damages arising from your use of the site, and our total liability for any claim related to an order or purchase is limited to the amount you paid for it. Some places don’t allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under law that cannot be waived.

We may update these terms. We’ll post changes on this page with a new date. Orders placed before a change follow the terms in effect when the order was placed.

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules, except where applicable law requires otherwise.
